Our services are available to residential and commercial property owners or authorized representatives who are legally able to enter into binding agreements under Ontario and Canadian law.
We reserve the right to refuse service to anyone, at any time, for any reason. We reserve the right to make any modifications to the website, including terminating, changing, suspending, or discontinuing any aspect of the website at any time, without notice.

All quotations and estimates made and orders accepted by Smile HVAC are subject to these Terms and Conditions.

If any given completion date is delayed for any reason beyond our control — including but not limited to inclement weather, accidents, loss or damage of any kind, labour disputes, or the inability to secure labour and/or materials — a fair and reasonable extension of time shall be granted to Smile HVAC.
The customer will provide adequate space at the job site to allow our technicians to store all materials required for the installation or service.
You agree to pay all applicable charges (including applicable taxes) for any products or services purchased from Smile HVAC. Unless otherwise indicated, all prices are displayed in Canadian dollars.
Payment in full shall be made on the day of completion of the works, unless otherwise agreed in writing. Any unpaid amounts shall accrue interest at the maximum rate permitted by applicable Ontario law.
On full payment made by credit card, a transaction processing fee may apply. This fee will be disclosed at the time of payment.
All deposits paid to Smile HVAC are non-refundable unless otherwise specified in writing. Smile HVAC retains title to all equipment and materials furnished until final payment is received in full.
If payment is not made as agreed, Smile HVAC reserves the right to remove installed equipment or materials at the customer’s expense, and/or pursue additional legal remedies, including the placement of construction liens. The customer is responsible for all legal fees and costs incurred by Smile HVAC in the enforcement of payment obligations.
YOU AGREE THAT YOU WILL NOT INSTALL, ACTIVATE, OR OPERATE ANY HVAC PRODUCTS OR EQUIPMENT PURCHASED OR INSTALLED THROUGH SMILE HVAC UNLESS SUCH INSTALLATION OR ACTIVATION IS PERFORMED OR INSPECTED BY A CERTIFIED TECHNICIAN IN ACCORDANCE WITH ALL APPLICABLE LAWS, BUILDING CODES, AND MANUFACTURER SPECIFICATIONS.
The customer is responsible for ensuring that the property meets all necessary prerequisites for the installation, including adequate electrical supply, gas connections, ductwork condition, and structural requirements, unless otherwise agreed in writing.
All materials, parts, and equipment are warranted solely by the respective manufacturer’s warranty. Smile HVAC makes no additional warranties with respect to any equipment or materials beyond those provided by the manufacturer.
All labour performed by Smile HVAC is warranted according to the specifications outlined in the service agreement or invoice. Labour warranties are void if the installed equipment or system is subsequently worked on by any party other than Smile HVAC or its authorized technicians.
Smile HVAC agents and technicians are not authorized to make any warranties on behalf of the company other than those contained in the written service agreement.
All manufacturer warranty registrations are the responsibility of the customer and should be completed promptly after installation.
The website and its entire contents, features, and functionality — including all information, software, text, displays, images, video, audio, and design — are owned by Smile HVAC, its affiliates, licensors, or other providers of such material, and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.
